SPORTS SERIES NO ANNUAL FEES REQUIRED PROMOTION TERMS AND CONDITIONS

These terms and conditions apply to SkyGolf’s no annual fees required promotion in connection with new WATCH 1, AIRE™ and GIMME™ SPORTS SERIES ™ SKYCADDIE® products.

If you first register a new, eligible Sports Series SkyCaddie device during the promotion period defined below, you will not, during the useful life of your device, be required to pay an annual fee to use the SKYCOURSES® preloaded on your eligible device at time of purchase or to access available SkyCourse map updates for use with such device.

Eligible Sports Series SkyCaddie models are the Watch 1, the Aire™ and the Gimme™, which provide only basic features and require lower ongoing maintenance support because, for example, they have full course loads and do not require periodic course downloads. The no annual fees required promotion applies only to new eligible Sports Series SkyCaddie models and only to the original consumer purchaser of such models. You may not transfer the no annual fees required offer to another device, whether or not the other device is a Sports Series SkyCaddie model, or to another person.

The promotion period is August 15, 2013 through February 15, 2014, and the offer of no annual fees required only applies to eligible Sports Series model units first registered by the original consumer purchaser during the promotion period.

The SkyGolf promotion is good only as long as supplies last. SkyGolf reserves the right to cancel the promotion at any time.

A device’s useful life means the period during which the device (1) has sufficient memory capacity and other required technical capabilities to utilize then current map data and operating system updates, if any, provided by SkyGolf, (2) is capable of operating as intended without major repairs and (3) has not become obsolete, including, without limitation, on account of the inability to reasonably obtain required parts or components. If you have not downloaded a course update within any eighteen (18) month period, your device will be deemed out of service and its useful life ended. If your eligible Sports Series device does not have sufficient memory remaining to load an update to the map data, you will need to reduce map coverage to receive updates. If you are unable or unwilling to reduce map coverage, your device will be deemed out of service and its useful life ended. If the useful life of your device has ended solely because you either have not downloaded a course update within 18 months or were unable or unwilling to reduce map coverage to receive course updates, you may continue to use the courses loaded on your device as long as your device’s useful life has not otherwise ended and your device is functionally operational without maintenance or support from SkyGolf.

The SkyCourses for which no annual fees will be required are those SkyCourses which come preloaded on your eligible device at time of original purchase, and the SkyCourse updates you will have access to are those SkyCourse updates within your device’s original design capabilities that are made available by SkyGolf for the courses which come preloaded on your eligible device at time of original purchase.

The terms of the separate no annual fees required SkyGolf end user license agreement shall also be applicable to the Sports Series no annual fees required offer and your use of your eligible Sports Series device. SkyGolf may terminate your use of SkyCaddie software or your access to course updates at any time you violate any of the terms and conditions of such end user license agreement.
